F\u00fcr Kinder von Eltern, die vor dem 31.12.1999 geboren wurden, gilt die alte Rechtslage.<\/p>\n<p>Nach fr\u00fcherer Rechtslage erwarben Kinder deutscher Eltern oder eines deutschen Elternteils, die ihrerseits bereits im Ausland geboren wurden, bei Geburt im Ausland von Gesetzes wegen die deutsche Staatsangeh\u00f6rigkeit. Demgegen\u00fcber gilt dies f\u00fcr Kinder, deren Eltern nach 2000 geboren wurden, nicht mehr. Deren Kinder erwerben nicht mehr automatisch die deutsche Staatsangeh\u00f6rigkeit. Gesetzeszweck hinter dieser Regelung ist die Annahme, dass in diesen F\u00e4llen eine enge Bindung zu Deutschland nicht mehr gegeben ist, weil die Eltern im Ausland leben und selbst dort geboren wurden.<\/p>\n<p>Eine Ausnahme besteht nur im Fall, dass das Kind durch die Versagung des Erwerbs der deutschen Staatsangeh\u00f6rigkeit staatenlos w\u00fcrde. Dann erwirbt es weiterhin aufgrund Gesetzes die deutsche Staatsangeh\u00f6rigkeit.<\/p>\n<p>Es besteht jedoch eine M\u00f6glichkeit, dass das im Ausland geborene Kind auf Antrag die deutsche Staatsangeh\u00f6rigkeit erwirbt. Hierzu ist erforderlich, dass die Eltern bei der zust\u00e4ndigen Auslandsvertretung innerhalb eines Jahres nach der Geburt des Kindes die Geburt anzeigen. Diese Jahresfrist ist zwingend, andernfalls ist das Kind vom Erwerb der deutschen Staatsangeh\u00f6rigkeit ausgeschlossen. Daher sollten im Ausland geborene und dort lebende deutsche Eltern, die ihrem Kind den Erwerb der deutschen Staatsangeh\u00f6rigkeit erm\u00f6glichen wollen, die Anzeige bis zum 1. Geburtstag des Kindes zwingend im Blick behalten.<\/p>\n<p>Zur Veranschaulichung der neuen Rechtslage sei folgendes Beispiel genannt:<\/p>\n<p>Herr Alt wird am 2.1.2000 als Kind deutscher Staatsangeh\u00f6riger in Kanada geboren. Er erwirbt bei Geburt automatisch die deutsche Staatsb\u00fcrgerschaft. Bekommt Herr Alt nun im Jahr 2020 mit seiner Freundin, der kanadischen Staatsangeh\u00f6rigen Frau Young einen Sohn, John, der am 7.5.2020 geboren wird, so erwirb dieser nicht automatisch die deutsche Staatsangeh\u00f6rigkeit. Vielmehr muss Herr Alt noch vor dem 7.5.2021 bei einer deutschen Auslandsvertretung in Kanada die deutsche Staatsb\u00fcrgerschaft f\u00fcr John beantragen.<\/p>\n<\/div><\/div><\/div><\/div><\/div>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":10,"featured_media":3983,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[12],"tags":[],"class_list":["post-407","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-rechtstipps"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v28.4 -
