Die Gr\u00fcnde daf\u00fcr sind vielf\u00e4ltig: Sie reichen vom puren Vers\u00e4umnis bis zum Irrglauben, man m\u00fcsse f\u00fcr Bankkonten oder Wohneigentum in Deutschland gemeldet sein. Viele Mandanten stellen sich die Frage, welche Konsequenzen es hat, wenn sie noch in Deutschland gemeldet sind. Tats\u00e4chlich sind diese vielf\u00e4ltig und sind der Mehrheit der Betroffenen nicht bewusst. Nachfolgend wollen wir die wohl wichtigsten Auswirkungen beleuchten.<\/p>\n<p style=\"font-weight: 400;\">Die Meldepflicht in Deutschland ist den meisten Betroffenen gut bekannt \u2013 genau so wichtig ist es jedoch, seinen Wohnsitz in Deutschland abzumelden, wenn man dauerhaft ins Ausland verzieht.<\/p>\n<p style=\"font-weight: 400;\">Zun\u00e4chst handelt es sich hierbei um eine Ordnungswidrigkeit gem. \u00a7 54 i.V.m \u00a7 17 Abs.2 Nr.2 BMG, die mit einer Geldbu\u00dfe bis zu 1.000,00 EUR geahndet werden kann. Des Weiteren h\u00e4ngt die Zust\u00e4ndigkeit bei der Beantragung eines neuen Reisepasses von dem jeweiligen Meldeort ab. Sind Sie noch in Deutschland gemeldet, ist die an Ihrem Meldeort gelegene Passbeh\u00f6rde in Deutschland f\u00fcr Ihren Reisepassantrag zust\u00e4ndig. Erst nach der Abmeldung des Wohnsitzes ist die Auslandsvertretung zust\u00e4ndig. Zwar ist es im Ausnahmefall m\u00f6glich, dass die Konsulate und Botschaften einen Reisepassantrag entgegen nehmen, obwohl Sie noch nicht abgemeldet sind, dies ist jedoch mit deutlich h\u00f6heren Geb\u00fchren und Verz\u00f6gerungen verbunden \u2013 und rechtlich falsch.<\/p>\n<p style=\"font-weight: 400;\">Zudem ist es besonders wichtig zu wissen, dass gerichtliche Schreiben und beh\u00f6rdliche Dokumente an Ihre deutsche Meldeadresse zugestellt werden k\u00f6nnen und hierdurch gegebenenfalls Fristen zu laufen beginnen, obwohl Sie keine tats\u00e4chliche Kenntnis von dem Inhalt erlangen. Die Zustellung gilt bereits als dann bewirkt, wenn die Dokumente an Ihrer Meldeadresse eintreffen. Wenn Sie also keine regelm\u00e4\u00dfige Nachpr\u00fcfung Ihrer Post am Meldeort vornehmen, kann dies schwerwiegende Folgen haben.<\/p>\n<p style=\"font-weight: 400;\">Weiterhin l\u00f6st ein gemeldeter Wohnsitz in Deutschland die rechtliche Vermutung aus, dass Sie sich dort auch regelm\u00e4\u00dfig aufhalten. Dies kann dazu f\u00fchren, dass das Finanzamt an ihrem Meldeort davon ausgeht, sie w\u00e4ren noch steuerpflichtig. Zudem ist der Zeitpunkt ihres Wegzugs auch relevant f\u00fcr die Frage nach einer Erbschaftsteuerpflicht f\u00fcr Sie oder Ihre Erben, auch wenn diese in Kanada leben. Zuletzt begr\u00fcndet ein in Deutschland angemeldeter Wohnsitz auch Ihre Kirchensteuerpflicht.<\/p>\n<p style=\"font-weight: 400;\">In den meisten Gemeinden in Deutschland k\u00f6nnen Sie inzwischen auch online Ihren Wohnsitz abmelden.
